NEW YORK (AP) --�J.C. Penney (NYSE: JCP  ) is sorry and it wants your business back.

That's the gist of its latest ad, a public "mea culpa" which the mid-priced department-store put on its YouTube and Facebook (NASDAQ: FB  ) pages.

The ad, titled "It's no secret," shows shots of women working, playing with their children, and doing other everyday activities.

"Recently J.C. Penney changed," a voiceover states. "Some changes you liked, and some you didn't. But what matters with mistakes is what we learn. We learned a very simple thing, to listen to you."

The ad comes after the Plano, Texas-based company earlier this month fired its CEO, Ron Johnson, after 17 months on the job and rehired his predecessor, Mike Ullman.

Johnson's ambitious changes included getting rid of most sales and bringing in new, hip brands. The strategy was designed to attract younger, wealthier shoppers in a bid to reinvent the stodgy retailer, but it alienated Penney's loyal customers and caused sales to plummet.

    Shares of�Staples� (NASDAQ: SPLS  ) got hammered, falling 15% after posting a dismal fourth quarter, and saying it would close 225 stores, or more than 10% of its total, by next year. With nearly half of its sales coming online now, the nation's No. 1 office retailer said the store closures made sense, and would help cut costs by $500 million. Sales in the quarter fell 3.8%, to $5.87 billion, after adjusting for the extra week in 2012, below estimates of $5.97 billion, while its $0.33 per-share profit also missed estimates at $0.39. Online sales were up 10%, indicating that there may be hope for its e-commerce strategy, though same-store sales fell 7% at North American locations. First-quarter guidance was also weak as the company expects a profit of $0.17-$0.22 against estimates of $0.27. Staples' report makes clear that office retail is fundamentally changing and, while it may find success as an online retailer, I wouldn't expect it to have the same advantages it does as a bricks-and-mortar store.

We continue to buy and patiently harvest broadly diversified portfolios of undervalued stocks for their long-term appreciation potential, says Jason Clark; in The Prudent Speculator, he looks at three consumer-related ideas.

Shares of Hasbro (HAS) advanced 10% after the maker and seller of toys reported earnings and revenue that beat analyst expectations.

HAS reported earnings of $1.31 per share, versus consensus estimates for $1.28, on revenue of $1.37 billion. Period results were supported by cost control initiatives and strong international sales.

We boosted our Target Price for HAS to $56 and we note that the stock still yields 3%, despite the handsome gains enjoyed this year.

PetMed Express (PETS) announced that its fiscal Q2 net income climbed 5% on increased reorders, higher online sales, and lower operating expenses.

However, EPS came in a penny light of analyst expectations and shares of the pet pharmacy company were pummeled, dropping more than 12% on the news. We still like PETS' solid balance sheet, cash flow generation, and 4.6% dividend yield.

As Airline Profits Soar, Is Labor Unrest Inevitable?

Earnings at the top U.S. airlines -- particularly American Airlines (NASDAQ: AAL  ) , Delta Air Lines (NYSE: DAL  ) , and Southwest Airlines (NYSE: LUV  ) -- have soared in the past two years or so. In many ways, a new golden age of the U.S. airline industry has begun.

However, as airline profits soar, it's natural for employees to look for pay increases and work rule improvements. That's especially true because employees had to endure reverses on both fronts in the past 10-15 years. This tension recently revealed itself strikingly as American Airlines flight attendants rejected a lucrative contract offer from management.

In September, Delta Air Lines announced that it would give employees an early profit sharing payout this year to reward them for the company's surge in profitability. Delta also promised a 3%-4% raise for all front-line employees next year.

Coincidentally, Delta announced these raises around the same time that American Airlines and its flight attendant union were putting the finishing touches on a tentative contract agreement.

The Association of Professional Flight Attendants had committed to negotiating an industry-leading contract with American's management team. Delta's raises meant that the just-completed contract was no longer the best in the industry. So the APFA went back to American Airlines' management and got a match for the Delta raises, worth $13 million annually.

The proposed contract would have allowed American Airlines and US Airways flight attendants to leapfrog other flight attendant groups to become the best paid in the industry, so it seemed like a no-brainer that union members would ratify it. Instead, the APFA announced on Sunday that the ratification vote failed, with 8,180 votes in favor and 8,196 opposed.

A strange situation

Normally, when union membership rejects a tentative contract agreement, management and the union resume negotiations in order to reach an agreement that can find enough support for ratification. However, American Airlines' unions and management already agreed on an expedited arbitration process in the event of a failed ratification vote.

Under the terms of this agreement, the arbitration award is capped at parity with Delta's industry-leading contact. As a result, the company and the union both agree that the contract terms determined by arbitration will be worse than what the flight attendants just rejected!

This could make for a quick arbitration process. Both sides have already agreed to an industry-standard contract, so there's not much left to "arbitrate." Presumably, American would assent to the maximum $111 million in contract improvements, putting its flight attendants at parity with Delta's. That would represent an $82 million savings over the life of the contract compared to the agreement that was just rejected.

Are bad labor relations back?

Presumably, the thousands of American Airlines flight attendants who voted against the tentative agreement want better contract terms -- not worse ones. Given that American Airlines now has a clear legal path to imposing contract terms that are less generous than what it had previously offered, it's clear that the flight attendants are playing "chicken" with management.

If the union and management team go ahead with the arbitration process, it will undoubtedly make a lot of flight attendants bitter. In the long run, that's probably not worth the relatively small amount of savings that American would achieve.

That's why thousands of flight attendants are betting that American Airlines will offer a better deal in mediation talks before going to binding arbitration. Yet there is a very strong possibility that the union and management team will end up in arbitration anyway, locking the flight attendants into a contract inferior to the one they just rejected.

This isn't the only battleground

The American Airlines flight attendant contract is one of many recent instances of contentious bargaining in the airline industry. Southwest Airlines has traditionally had excellent labor relations, yet a recent piece in Businessweek described its workforce as "disgruntled."

Sure enough, 10 union leaders -- representing the vast majority of Southwest's employees -- sent a letter to Southwest CEO Gary Kelly in June, claiming that employee morale was at an all-time low. The union leaders suggested that the inability to reach long-term contract agreements with Southwest was one of the biggest problems.

Meanwhile, the International Association of Machinists -- a prominent airline union -- is making a push to represent flight attendants at Delta. (Most Delta employees, including flight attendants, are not currently unionized.)

Rising health insurance premiums have been a key point emphasized by the IAM in pitches to potential members at Delta. It's far from certain that it will succeed in its unionization drive. But the fact that it's even trying when Delta flight attendants have the best pay in the industry shows that many employees want even better terms in light of Delta's record profitability.

The next few months could be key

American Airlines and the APFA union have just a few months to try to hammer out a revised agreement in mediation before going to binding arbitration. The arbitration result is certain to be worse than the contract terms that American's flight attendants just rejected.

Stocks soared today as the monthly jobs report came in above expectations. The Dow Jones Industrial Average (DJINDICES: ^DJI  ) finished up 207 points, or 1.4%, to close the week at 15,248.

The Labor Department reported that 175,000 jobs were added in May, better than consensus projections at 159,000. However, the jobs report was not stellar across the board as private-sector jobs only beat estimates by 3,000, and the unemployment rate ticked to 7.6% from 7.5% in April. The Labor Department also revised down its estimate of jobs created in April from 165,000 to 149,000. Given the negatives in the report, the market's reaction seems to be a bit exaggerated.

Boeing (NYSE: BA  ) was the biggest winner out of the blue chips, gaining 2.7%, as the aerospace maker was a part of a $4 billion deal announced today that includes Rolls-Royce and Singapore Airlines. According to the agreement, Rolls Royce will provide engines for 50 Boeing 787 jets. The aerospace giant shares have continued to move higher now that its Dreamliner battery fire problems have been resolved. Boeing hit a five-year high today, and shares are up 35% this year.

    Just last week, the major US stock averages hit all-time highs, led by large-cap stocks, including some that had been lagging for many years. But it’s been a different story in March-April for stocks that had the biggest gains of 2013 and early this year.

Yet the S&P 500 and Dow Jones Industrial Average remain not far from their all-time record peaks, down 3 percent and 2.5 percent respectively.

    There are many reasons for the decline of both the junk and the good growth stocks. First, the broad market has been long overdue for a 10 percent correction, which still hasn’t occurred.

    Second, the high fliers were much more overdue for a reality check. These particularly include extremely overvalued companies in social media, the “cloud,” 3d printing, biotechnology and more.

    Third, the new-issues market, which naturally has consisted primarily of info tech and biotech issues, created too much new supply that inevitably dampened investor demand for the more established companies in those sectors.

Carter/AP Dollar General (DG) upped its bid for the rival Family Dollar chain and addressed an earlier roadblock, saying that it will more than double the number of stores it would shed to tamp down the antitrust concerns of its takeover target. The newest bid is worth $9.1 billion, or $80 a share, up from $78.50 a share in the previous offer. Family Dollar (FDO), based in Matthews, North Carolina, rejected the earlier bid in favor of a lesser offer of $8.5 billion from Dollar Tree (DLTR), saying that regulators were less likely to stand in the way. On Tuesday Dollar General, the country's largest dollar-store chain, said it would divest as many as 1,500 stores, well above the 700 that it had originally agreed to, in order to sidestep any anti-monopoly actions that regulators might pursue. The Goodlettsville, Tennessee, company has also said it will pay a $500 million reverse break-up fee to Family Dollar Stores if the deal hits antitrust roadblocks. Dollar General Chairman and CEO Rick Dreiling said that a second antitrust review supported its prior bid, but that its offer was revised "to demonstrate the seriousness of our commitment." The businesses of Family Dollar and Dollar General are more similar than Dollar Tree's. The first two sell items at a variety of prices while at Dollar Tree, all items are a buck. Family Dollar has been looking for a lifeline after running into some financial stress, shuttering stores and cutting prices. In June one big shareholder, Carl Icahn, urged the company to put itself up for sale. Family Dollar acted one month later, accepting an offer from Chesapeake, Virginia-based Dollar Tree of $59.60 in cash and the equivalent of $14.90 in shares of Dollar Tree for each share held. The companies valued the transaction at $74.50 a share at the time. Including debt and other costs, Family Dollar and Dollar Tree estimated the deal to be worth approximately $9.2 billion. Shares of Family Dollar added 54 cents to $80.

The bank wrote down about $400 million of loans backed by the bogus invoices.

    Sales growth this last quarter was up only about 6%, but net income per share was up 21%. They pay a $0.60 dividend which gives them a dividend yield of 1.4%. Their cash flow yield is 4.6%, so they could easily raise their dividend. They are by far the leader in a very fragmented industry. I believe both [Vitamin Shoppe (NYSE: VSI  ) ] and GNC will do well and I think they may make a fair pairing in a portfolio. Stability versus growth.

    They do have $1.1 billion in debt. But they generate about $200 million in cash flow a year and they have $174 million in cash, so that shouldn't be a problem. Their cash flow is very high, so in my opinion, is reason enough to believe they will beat the S&P 500 over the next ten years.

Then came the wave of the megalithic superstores that drove out the smallest booksellers and led to industry consolidation.�

    Barnes & Noble (BKS) was falling around 6% at recent check, despite reporting a surprise profit in its second quarter, as sales declined across its major segments.

    The struggling bookseller reported earnings of $13.2 million, or 15 cents a share, well ahead of the seven-cent per share loss a year earlier. Analysts were expecting the company to post another loss this quarter, anywhere from three to 11 cents, depending on which source you use.

    Sales fell 8% year over year to $1.73 billion, just shy of the $1.76 billion consensus.

    Gross margin improved to 26.6% from 25.6%, on a 9.3% drop in costs of sales and occupancy. Selling and administrative costs were down 7.1%.

    Revenues at its retail segment dropped 7.5% year over year in the quarter, while its college division reported a 4.6% decline in sales. Nook revenues dropped 32%.

    Barnes & Noble also reaffirmed its previously announced full-year guidance, which calls for same-store sales declines in its retail and college stores.

    It�� been a tumultuous year for Barnes & Noble, as it has abandoned plans to split itself in two and Chairman Leonard Riggio decided against purchasing the company�� consumer bookstores.

Not only did the bookseller discontinue tablet hardware, but also the company just announced that its CEO has resigned. The Nook segment's EBITDA losses nearly doubled last fiscal year to $475 million, and B&N appointed CFO Michael Huseby as the new CEO of the Nook Media subsidiary.
